Anova Policies and Procedures Under Title III of the Americans with Disabilities Act (ADA)
Anova does not discriminate against its students or their parents on the basis of their disabilities, including disabilities affecting behavior, in the full and equal enjoyment of all Anova services, facilities, privileges, advantages, or accommodations.
Upon request from a parent of an enrolled student to the school Director or designee, Anova will appropriately consider requests for behavioral supports and interventions. The request will be first considered at the school staff level. Further consideration, if needed, will be in consultation with the student’s placing district. If appropriate, an administrative amendment will be drafted or an IEP team meeting will convene with all staff involved in the implementation of the student’s individualized supports, interventions, and, if applicable, restraints, within 30 days of the parent’s request for the supports and interventions. Anova, in all aspects in consideration of a parent request, will review relevant data and input from parents and staff to address the need for reasonable modifications, different or additional supports, including modifications to the student’s Behavioral Intervention Plan (“BIP”), or the need for a new or additional Functional Behavior Analysis (“FBA”).
In the event a student is restrained under the provisions of Anova’s adopted “Physical Management of Challenging Behavior” procedures, staff will meet within one week of the restraint with an invitation to parents to participate. The purpose of this meeting is to consider the effectiveness of supports and interventions employed prior to the restraint. If changes to supports or interventions are appropriate, these will be adopted by an IEP administrative amendment or IEP team meeting convened within 10 days of the staff meeting following the restraint.
